1. Acceptance of Terms

By accessing and using the AltiusTutors platform ("Platform") at altiustutors.com, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these Terms, please do not use our Platform.

These Terms constitute a legally binding agreement between you and AltiusTutors regarding your use of our Platform and services.

2. Platform Description

AltiusTutors is an online marketplace that connects students seeking academic assistance with qualified tutors. Our Platform facilitates:

• Tutor discovery and profile browsing
• Booking of trial lessons with a one-time fee
• Communication between students and tutors
• Secure payment processing for trial lessons
• Session management and scheduling

Important: AltiusTutors acts solely as an intermediary platform. We do not provide tutoring services directly, nor do we employ tutors. Tutors are independent contractors who provide services directly to students.

3. User Accounts and Registration

To use certain features of our Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate and current
• Protect your account credentials and not share them with others
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Payment and Fees

Trial Lesson System: AltiusTutors operates on a simple trial lesson model:

• Trial Fee: Students pay a one-time fee of $29 to book their first session with a tutor
• No Ongoing Fees: After the trial lesson, AltiusTutors does not take any commission or ongoing fees
• Direct Payment: Tutors receive 100% of their lesson fees directly from students
• Payment Processing: Trial fees are processed securely through Stripe

Important: All payments for subsequent lessons are arranged directly between students and tutors. AltiusTutors is not involved in these transactions and cannot guarantee payment or resolve payment disputes.

6. Booking and Cancellation Policy

Booking Requirements:

• Bookings must be made at least 1 week in advance
• Bookings cannot be made more than 4 weeks in advance
• All required fields must be completed before booking
• Trial lesson fee must be paid before booking confirmation

Cancellation Policy:

• Cancellations must be made at least 24 hours before the scheduled session
• Late cancellations may result in the trial fee being forfeited
• Refunds for valid cancellations will be processed within 5-7 business days
• No-shows will result in forfeiture of the trial fee

7. Prohibited Activities

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems to access the Platform
• Interfere with or disrupt the Platform's functionality
• Attempt to circumvent our payment system
• Provide false or misleading information
• Harass, abuse, or harm other users
• Use the Platform to solicit business outside of AltiusTutors

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by AltiusTutors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to the Platform, but you grant us a license to use, display, and distribute such content in connection with our services.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

10. Disclaimers and Limitations

Service Disclaimer: AltiusTutors provides a platform for connecting students and tutors. We do not:

• Guarantee academic outcomes or specific results
• Employ or supervise tutors
• Provide tutoring services directly
• Guarantee tutor availability or quality
• Handle payments for lessons after the trial

Limitation of Liability: To the maximum extent permitted by law, AltiusTutors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

11. Indemnification

You agree to indemnify and hold harmless AltiusTutors, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Platform or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Platform will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of Australia.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.
